Terms and Conditions

These Terms are applicable to all Contracts of any kind made by The Old Ferry Inn ("the Inn") and its clients ("the Clients") and apply to all reservations, bookings and agreements for accommodation, dining, function room hire and use of all services at The Old Ferry Inn, Bodinnick and use of this website.

These terms apply to all bookings to the exclusion of all other terms and conditions except to the extent of specific terms for a particular booking that have been signed in writing by an Authorised Representative of the Inn.

Clients are invited to read these provisions and note their responsibilities, arrangements for payments, cancellation, terms and limitations on the liability of the Inn.

The issue of a Booking Confirmation by the Inn to the Guest or Client is deemed acceptance of these terms.

Arrival

means the date on which the Services are to be provided or shall start to be provided by the Inn

Client

means the person or Company for whom the Inn has agreed to provide the Services in accordance with these Terms

Contract

means the contract for the provision of the Services including these Terms as appropriate

Services

means the provision of accommodation, room hire and/or supply of food and beverages and other Services by the Inn for the Client described in writing by the Inn and on its website or in its brochure

Standard Charges

means the charges shown in any brochure of the Inn or other published literature relating to the Services in force from time to time

means these terms and conditions

Supply of Service

The Inn shall provide the Services to the Client subject to the Contract.

The Client shall at its own expense supply the Inn with all necessary data or other information relating to the Services within sufficient time to enable the Inn to provide the Services in accordance with the Contract. The Client shall ensure the accuracy of all such information. Specific information requirements are contained in the Schedule. The Inn may at any time without notifying the Client make any changes to the Services which are necessary to comply with any applicable safety or other statutory requirements, or which do not materially affect the nature or quality of the Services. 


Charges

The charges payable by the Client shall be detailed by a booking confirmation by the Inn.

If no charges are specified or additional and varied Services are provided to the Client, the Client shall pay the Standard Charges at the prevailing rate on the day the Services are provided and any additional sums which are agreed between the Inn and the Client for the provision of the Services.

All charges quoted to the Client for the provision of Services are inclusive of any Value Added Tax (VAT) at the applicable rate at the tax point unless otherwise stated.

A minimum length of stay, deposit, cancellation charge and other conditions may also apply to certain rates, which will be separately identified on the booking confirmation.

Payment

Clients will be asked to provide a credit or debit card at the time of the Booking to secure the reservation.

A deposit is required for each room booked at the time of booking.

We accept the following methods of payment: Credit Cards: MasterCard / Diners International, Diners Club, JCB International Debit Cards: Visa / Delta and Visa / Electron. The Guest must pay all outstanding charges on departure from the Inn.

Online Payment security

We take security very seriously and we use one of the UK’s leading card payment processors, Secure Trading to protect your credit card details.

When you enter your credit card details, it is automatically protected using something called a Transport Layer Security (TLS) between your computer and Secure Trading. TLL works in the following ways:

  • it prevents impersonation - you can tell that you are using a genuine SSL site by the padlock symbol on your screen. Clicking on either the padlock or the image at the foot of each page (dependant upon which Internet Browser is being used) will reveal the Registration Certificate that is issued to Secure Trading;
  • it encrypts data - as soon as your computer has recognised Secure Trading’s computer they encrypt all information that is passed between them. Data encryption means that no one else can read or change your information as it travels over the Internet; it prevents scrambling - TLS uses a Message Authentication Code (MAC) to prevent anyone tampering with their Internet site. Your computer will always check this code before it takes a message from Secure Trading. This means that if anyone tried to interfere with a message, your computer would not recognise the code and would alert you.


Cancellation and Non-Arrival

All deposits are non-refundable unless the room can be re-let.

Change of Booking Details

Reservations may be amended but any change to the arrival date, departure date or room type is subject to availability at the time the change is requested and may result in a possible rate change. Any deposit / prepayment held will continue to be subject to the terms and conditions at the time of the original booking.

Arrival and Departure

Guests may check-in at any time from 2.00 p.m. on the day of arrival. All rooms that have been secured by credit / debit card or prepaid at the time of booking will be held until 12.00 noon on the following day. Any non-secured reservation will be held until 4.00 p.m. on the day of arrival at which time the hotel is entitled to re-let the room, unless the guest has notified the hotel of a late arrival.

On the day of departure we kindly ask all guests to vacate their rooms by 10.30am (unless a later departure is stated as part of your booking). Late check-out after this time can be requested subject to availability, and may be subject to an additional charge.

Parking

We have a small car park free to our guests and clients a short walk away from the Inn (approximately 50 meters) which is subject to availability and cannot be guaranteed. There is also limited on-street parking, and a public car park (approximately 100 meters away), we cannot guarantee that a car space is available in either of these locations.

We do not accept responsibility for damage to, or theft from, or theft of vehicles parked on the Inn premises.

Accessibility

Due to the age and location of the Inn disabled access is severely limited, please call us on 01726 870237 to discuss specific individual requirements and the availability of appropriate accommodation.

Children

Children aged 16 years and under must be accompanied by a responsible adult at all times to ensure that the children's behaviour is appropriate for other guests within the Inn. Subject to the availability of suitable accommodation, a charge of up to £25 is made for children aged 15 years and under when sharing a room with two adults.

At our discretion children may be excluded from certain events or promotions where deemed unsuitable or inappropriate.

Dogs and other pets

Normal domestic pets are accepted at our discretion provided that they are kept strictly under control and that they are clean, free from disease and not dangerous. With the exception of guide and hearing dogs all normal domestic pets are not allowed in the dining room of the Inn, but are permitted in other public areas. Please check in advance with us for further details.

A charge of £7.50 per night is made for each pet, except for guide dogs and hearing dogs. The Guest is responsible for controlling the pet (including guide dogs and hearing dogs) and will be liable for any damage, soilage or injury however caused by the pet.

Smoking

We operate a non-smoking policy in all indoor areas of the Inn. As all bedrooms at our Inn have been designated non-smoking should you choose to smoke in your room we reserve the right charge you £100.00 to cover the cost of cleaning the room and for the disruption caused.

Client Responsibilities

We reserve the right to judge acceptable levels of noise or behaviour of Clients and their guests or representatives, who must take all steps for corrective action as requested by us. In the event of failure to comply with our requests, we may terminate the booking, stop any event immediately and / or ask the Client to vacate the premises immediately. No refunds or compensation will be given in these circumstances and we reserve the right not to accept any future bookings from the Client, their guest or any representative.

We reserve the right to refuse a Client, and their guest or any representative entry and accommodation if, on arrival, management reasonably considers that the person is under the influence of drink or drugs, is unsuitably dressed or is behaving in a threatening, abusive or otherwise unacceptable manner.

Discrimination

We do not discriminate on the grounds of race, colour, nationality, religion, sex, marital status, age, ethnic origin or disability.

We expect all Clients and including their employees, representatives and sub-contractors to adhere to this policy and we may, without incurring any liability to the Client, remove from the Inn any person or persons offending against this policy.

External Purchases

No wines, spirits, beers or food may be brought into the Inn or Inn grounds by Clients and their guests or representatives for consumption or sale on the premises without the express written consent of the Inn, for which a a charge may be made.

Licensing and Statutory Regulations

The Inn is subject to statutory controls, including those relating to fire, licensing, entertainment, health, hygiene and safety. These must be strictly observed by Clients, their guests and representatives.

Liability

When the Inn supplies the Services which include any services supplied by a third party, the Inn does not give any warranty, guarantee or other term as to their quality, fitness for purpose or otherwise, but shall, where possible, assign to the Client the benefit of any warranty, guarantee or indemnity given by the person supplying the services to the Inn. The Inn shall have no liability to the Client for any loss, damage, costs, expenses or other claims for compensation arising from any instructions supplied by the Client which are incomplete, incorrect, inaccurate, illegible, out of sequence or in the wrong form, or arising from their late arrival or non-arrival, or any other fault of the Client. Except in respect of death or personal injury caused by the Inn’s negligence, or as expressly provided in these Terms, the Inn shall not be liable to the Client by reason of any representation (unless fraudulent), or any implied warranty, condition or other term, or any duty at common law, or under the express terms of the Contract, for any loss of profit or any indirect, special or consequential loss, damage, costs, expenses or other claims (whether caused by the negligence of the Inn, its servants or agents or otherwise) which arise out of or in connection with the provision of the Services (including any delay in providing or failure to provide the Services) or their use by the Client, and the entire liability of the Inn under or in connection with the Contract shall not exceed the amount of the Inn’s charges for the provision of the Services, except as expressly provided in these Terms.

Force Majeure

The Inn shall not be in breach of this Agreement if it does not provide the services under this Agreement due to the following circumstances:

  • Industrial action by the Inn’s employees
  • Industrial action by the staff of one of the Inn’s suppliers Fire, lighting, explosion, riot, civil commotion, malicious damage, extreme weather conditions, storm, flood, burst pipes, earthquake, terrorism and the Inn being damaged or destroyed
  • Postal bookings which do not reach the Inn
  • Breakdown of machinery, or any failure to supply the inn with gas, electricity, water and so on, outside the control of the Inn.


If any of the above occurs the Inn will do its best to avoid any inconvenience to the Client. The Inn does not accept any responsibility for the Client’s personal property nor those of its guests, employees, representatives, invitees or contractors including gifts, presents, seminar, conference, exhibition, or other corporate presentation material or such other items brought by the Client, its employees, Guests, representatives, invitees or contractors to the Inn (cumulatively referred to as the “Client’s Property”).

The Inn may, at the request of the Client, provide personnel to assist in carrying, directing, placing, installing or setting up (as the case may be) the Client’s Property. The Inn will not assume custody or control of such articles, which remain on Inn premises at the owner’s risk. In such an instance, the Client acknowledges and accepts that the Client shall remain responsible for the Client’s Property and shall not hold the Inn liable in any manner whatsoever.

The Client is responsible for any damage caused to the allocated rooms, its furnishings, utensils, fixtures and fittings and equipment in such rooms by any act, omission, default or neglect of the Client, their guests, employees, representatives, invitees or contractors and shall pay to the Inn on demand the amount required to make good or remedy any such damage. Clients should ensure that valuables are covered by the Client's own insurance policy. The Hotel's liability is limited to the terms of the Hotel Proprietors Act 1956. Clients must report any loss of or damage to their property immediately on discovery to the Inn's Management, and shall make themselves available to assist with any reports made by the Inn to the police.

Clients shall not enter areas of the Inn which are indicated as being closed to the public. The Inn shall not be responsible for death, personal injury or loss or damage to property suffered by a Client including their guests or representatives.

Insurance

The Client is recommended to have and is responsible for insurance to cover cancellation, curtailment, and loss of baggage, personal effects and money.

Internet Facilities

Internet facilities are provided by third party providers. The Client acknowledges that there may be disruption to the connection without prior notice and the Inn shall not be liable whatsoever for such disruption. The Client further undertakes not to use the facility for any fraudulent purpose or in connection with any criminal offence and in contravention of any license and will indemnify the Inn against any claim, demand, suit, proceeding or prosecution arising therefrom.

Assignment

The Company shall have the ability to assign, subcontract or transfer any of its rights or obligations under the Agreement as it sees fit.

Third Party Rights

None of the terms of the Agreement are intended to be enforceable by any third party nor is it intended that this Agreement will confer any right on any person pursuant to the Contracts (Rights of Third Parties) Act 1999.

Variation

No variation of this Agreement shall be valid unless it is in writing and signed by, or on behalf of, each of the parties.

Waiver

Failure to exercise, or any delay in exercising, any right or remedy provided under this Agreement by law to the Company shall not constitute a waiver of that (or any other) right or remedy, nor shall it preclude or restrict any further exercise of that (or any other) right or remedy.

Severence

If any provision of the Agreement (or part of any provision) is found by a court to be invalid, illegal or unenforceable, that provision or part-provision shall, to the extent required, be deemed not to form part of this Agreement, and the validity and enforceability of the other provisions of this Agreement shall not be affected.

Right of Set Off

The Company shall have the ability to deduct any sums owed to it by the Guest against any sums it owes whether any such sum is present or future (whensoever arising), liquidated or unliquidated, under this Agreement or not. Any exercise by the Company of its rights under this clause shall be without prejudice to any other rights or remedies available to it under this Agreement or otherwise.

Jurisdiction

The Agreement shall be governed by the laws of England and Wales and the Courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with this Agreement or its subject matter or formation.

We booked a family room overlooking the harbour, the room was spacious and had a fantastic waterfront view, the hotel had lots of character and the food was great, we missed the car ferry at 8.45 so we had to park the car Fowey side of the river and hop onto the little boat to cross the water it just added to the traditional feel of the hotel and the whole weekend break. Pascal and the staff at The Old Ferry couldn't do enough to help, we will be back.
